The Public and Administrative Law Department of CEW & PARTNERS, represented by Jean LAURENT and Charline SERVAIS, has won an important victory against the Belgian Federal Government in the Liège Court of Appeal.

CEW represented the Belgian Federation of Real Estate Agents in a legal challenge to specific COVID regulations which purported to prevent real estate agents from physically accompanying their prospective clients when visiting properties for sale or rent.

The Appeal Court, upholding the first instance judgment, held that it was an essential part of a real estate agent’s role to physically accompany their clients when visiting properties and that the prohibition was illegal and discriminatory.

The Court also firmly rejected the attempt by the Belgian government to further specify via an answer to FAQ’s the precise scope of the regulations.
